Scope<\/h2>\n  <p>These General Terms and Conditions (GTC) govern the business relationship between Diraya Intelligence GmbH (hereinafter referred to as the \u2018Provider\u2019) and its customers (hereinafter referred to as the \u2018Customer\u2019) in the version valid at the time of conclusion of the contract.<\/p>\n\n  <h2>2. Contracting parties and conclusion of contract<\/h2>\n  <p>The contract is concluded with Diraya Intelligence GmbH. A binding contract is created upon acceptance of an offer or order confirmation from the provider. The offers on the website do not constitute legally binding offers.<\/p>\n\n  <h2>3. Services<\/h2>\n  <p>Der Anbieter erbringt digitale Inhalte und Dienstleistungen, entweder individuell auftragsbezogen oder im Rahmen eines Abonnementmodells. Physische Waren werden nicht geliefert. Der genaue Leistungsumfang ergibt sich aus der jeweiligen Vereinbarung oder Leistungsbeschreibung.<\/p>\n\n  <h2>4. Prices and payment<\/h2>\n  <p>Alle Preise verstehen sich exklusive Mehrwertsteuer in Schweizer Franken (CHF). Die Zahlung erfolgt per Vorkasse oder gegen Rechnung, zahlbar innert 10 Tagen ab Rechnungsdatum. Bei Zahlungsverzug ist der Anbieter berechtigt, Leistungen bis zur vollst\u00e4ndigen Bezahlung auszusetzen.<\/p>\n\n  <h2>5. Term and termination of subscriptions<\/h2>\n  <p>Abonnements haben eine Mindestlaufzeit von drei (3) Monaten. Die K\u00fcndigungsfrist betr\u00e4gt drei (3) Monate bei einem Jahresabo und ein (1) Monat bei einem Monatsabo. Eine K\u00fcndigung auf den 31. Dezember ist ausgeschlossen. K\u00fcndigungen bed\u00fcrfen der Textform (z. B. E-Mail an info@diraya.ch) <a href=\"mailto:info@diraya.ch\">info@diraya.ch<\/a>).<\/p>\n\n  <h2>6. Rights of use<\/h2>\n  <p>The provider grants customers a simple, non-exclusive and non-transferable licence to use the digital content supplied. Transfer, sub-licensing or resale is not permitted. All intellectual property rights remain with the provider.<\/p>\n\n  <h2>7. Warranty and liability<\/h2>\n  <p>As no physical goods are delivered, there is no warranty or guarantee. The provider is only liable for damages caused by intentional or grossly negligent behaviour. In cases of slight negligence, the provider is only liable for breaches of essential contractual obligations, limited to typically foreseeable damages. Liability for indirect damages, consequential damages or lost profits is excluded to the extent permitted by law.<\/p>\n\n  <h2>8. Availability and support<\/h2>\n  <p>Der Anbieter strebt eine hohe Verf\u00fcgbarkeit seiner digitalen Leistungen an, kann jedoch keine ununterbrochene Erreichbarkeit garantieren. Wartungsfenster und notwendige technische Unterbr\u00fcche werden nach M\u00f6glichkeit vorab angek\u00fcndigt. Support erfolgt \u00fcber <a href=\"mailto:info@diraya.ch\">info@diraya.ch<\/a> or via a secure messaging app defined individually with the customer.<\/p>\n\n  <h2>9. Cancellation and withdrawal<\/h2>\n  <p>Under Swiss law, there is no statutory right of withdrawal for digital content or services. Withdrawal from the contract is only possible by mutual agreement.<\/p>\n\n  <h2>10. Data protection<\/h2>\n  <p>The processing of personal data is carried out in accordance with the <a href=\"https:\/\/diraya.ch\/en\/?page_id=682\" target=\"_blank\" rel=\"noopener\">Privacy policy<\/a> of Diraya Intelligence GmbH, which forms an integral part of these General Terms and Conditions.<\/p>\n\n  <h2>11. Amendments to the General Terms and Conditions<\/h2>\n  <p>The provider may amend these General Terms and Conditions at any time. Customers will be informed in advance of any significant changes and may agree to them or not. Without consent, existing contracts shall remain valid until the end of the agreed term under the previous conditions.<\/p>\n\n  <h2>12. Final provisions<\/h2>\n  <p>Swiss law applies exclusively, excluding conflict of laws provisions and the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Zurich, Switzerland.
